COURSE OUTLINE
We’ve recently witnessed a surge in the number of disrepair claims brought against social landlords. These claims often involve defending Environmental Protection Act prosecutions in the Magistrates Court, and since the new Fitness for Human Habitation Act came into effect for all existing tenancies on 20 March, the current influx is likely to turn into a flood of claims.
To help tackle your incoming claims, and future-proof your organisation against the possibility of even more, we’ve teamed up with Capsticks to deliver this interactive one-day training course.
The morning session will be ran by Capsticks’ team of expert surveyors. They realise it’s often the job of in-house surveyors to report on their initial findings once a disrepair case comes in. To help with this they’ll run a technical session on getting an accurate diagnosis, building pathologies and how to write effective in-house reports.
In the afternoon Capsticks’ team of disrepair lawyers will talk you through legislation and current issues including:
- responding to pre action protocol correspondence – tips, traps and best practice
- handling EPA prosecutions – process, dos and dont’s
- instructing the right surveyor – getting it right the first time
- tackling disrepair in the county court – all you need to know
- disrepair legislation and case law update
The session will also give you the opportunity to get involved in discussions about topical issues, to put questions to Capsticks’ expert disrepair team, and to network with your peers.

CLIVE ADAMS
Clive is Legal Director at Capsticks and is one of the founding members of the Asset Management Team. Clive has acted for social landlords for most of his professional career and in addition to the work now undertaken in the Asset Management Team has also advised and represented clients in areas such as defending disrepair claims, anti-social behavior possession and injunction claims.
